1. General Terms and Conditions
Franziska Mack Art & Design
1.1 These General Terms and Conditions (GTC) apply to all offers, sales and services of Franziska Mack, hereinafter referred to as "Artist".
1.2 Any differing terms and conditions of the customer shall not be recognized unless expressly agreed to in writing.
2. Offers and conclusion of contracts
2.1 All offers are non-binding and subject to change.
2.2 A contract is concluded as soon as the customer places an order or commissions an individual design or painting and the artist confirms it.
2.3 Changes or additions to individual orders are possible by arrangement, but may involve additional costs.
3. Prices and payment terms
3.1 Unless otherwise stated, the prices quoted are final prices.
3.2 Payment is made by bank transfer, PayPal, or cash and is due within, for example, 14 days after receipt of the invoice.
3.3 For individual custom orders, a deposit of 30% of the total amount is required.
4. Delivery and Shipping
4.1 Shipping will take place after full payment has been received to the address provided by the customer.
4.2 The customer bears the shipping costs unless a different agreement has been made.
4.3 The artist accepts no liability for delays caused by third parties (e.g. shipping service providers).
5. Right of withdrawal and return
5.1 Customers have the right to return standard products within 14 days without giving any reason.
5.2 Individually crafted artworks and designs created specifically according to customer wishes are excluded from the right of withdrawal.
5.3 The customer bears the return shipping costs unless the product is defective.
6. Copyright and usage rights
6.1 All works, drafts and designs are subject to the copyright of the artist.
6.2 Upon purchase, the customer acquires ownership of the physical artwork, but no rights of use or reproduction, unless expressly agreed in writing.
6.3 Commercial use or resale of individual designs requires a separate license agreement.
7. Consulting and creative services
7.1 Consulting services are provided to the best of the artist's knowledge, however, the artist assumes no liability for the subsequent implementation by the customer.
7.2 Designs created as part of the consultation remain the property of the artist until a separate usage license is agreed upon.
8. Disclaimer
8.1 The artist is not liable for damages resulting from improper handling or use of the artworks or designs.
8.2 Color variations between digital previews and the finished product are due to technical reasons and do not constitute a defect.
9. Final Provisions
9.1 Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
9.2 The law of the Federal Republic of Germany applies. The place of jurisdiction is Stuttgart.
